These Terms and Conditions (“Terms”) govern your use of the PaisaRecover platform at paisarecover.com (the “Platform”), operated by PaisaRecover (“we”, “us”, or “our”). By accessing or using the Platform, you agree to be bound by these Terms.
“User” means any individual or entity that registers on or uses the Platform. “Creditor” means a User who submits a debt recovery case. “Debtor” means the party against whom a recovery case is filed. “Trademark Seller” means a User who lists a trademark for sale. “Trademark Buyer” means a User who purchases a trademark through the Marketplace.
You must be at least 18 years old and legally competent to enter into a binding contract under the Indian Contract Act, 1872. If you are registering on behalf of a business or MSME, you represent that you have the authority to bind that entity. We reserve the right to refuse service to anyone for any reason.
You must provide accurate and complete information during registration. Your account is personal and non-transferable. You are responsible for maintaining the confidentiality of your password. You must notify us immediately of any unauthorized access to your account.
4.1 Nature of Services
PaisaRecover facilitates debt recovery through a structured process including calling, legal notice dispatch, mediation, and escalation to legal proceedings. We act as a facilitator and technology platform — we are not a law firm and do not provide legal advice.
4.2 No Guarantee of Recovery
We make best efforts to recover debts on your behalf, but we do not guarantee that any specific amount will be recovered, that the debtor will respond or cooperate, or that legal proceedings will result in a favorable outcome. Past results are not indicative of future outcomes.
4.3 Your Obligations as a Creditor
You represent and warrant that: the debt is genuine and legally enforceable, you have the legal right to claim the amount owed, all information and documents provided are accurate and not fraudulent, and you will cooperate with our team and any engaged legal professionals.
4.4 Pricing
Single Case: ₹3,500 per case. Annual Subscription: ₹8,500 for unlimited cases (12 months). Commission: 20% of recovered amount (Single), 15% (Subscription). Lawyer Escalation: ₹25,000 additional fee with 15% commission on recovery. All prices are inclusive of applicable taxes unless stated otherwise.
5.1 Listing a Trademark
Sellers must provide accurate trademark details including registration number, class, and ownership proof. All listings are subject to our verification process (24-48 hours). We charge a 25% commission on successful trademark sales.
5.2 Purchasing a Trademark
Buyers acknowledge that trademark transfer is subject to the Trade Marks Act, 1999, and requires filing with the Controller General of Patents, Designs, and Trademarks. We facilitate the transaction but the legal transfer is between buyer and seller.
We provide trademark filing assistance through qualified professionals. Government fees payable to the Indian Trademark Registry are separate and borne by the User. Filing does not guarantee registration; it is subject to examination by the Trademark Registry.
All payments are processed through Razorpay and are governed by Razorpay’s terms of service. Payments are in Indian Rupees (INR). We issue electronic receipts for all transactions. GST is applicable as per prevailing rates.
All content on the Platform including text, graphics, logos, UI design, code, and branding is the property of PaisaRecover and is protected under the Copyright Act, 1957 and the Trade Marks Act, 1999. You may not copy, reproduce, or distribute any part of the Platform without written permission.
You agree not to: submit fraudulent or fabricated debt claims, use the Platform for harassment, intimidation, or illegal purposes, attempt to gain unauthorized access to the Platform or other users’ accounts, upload malware, viruses, or harmful code, scrape, mine, or extract data from the Platform, or violate any applicable Indian law while using our services.
To the maximum extent permitted by law: PaisaRecover shall not be liable for any indirect, incidental, or consequential damages. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim. We are not liable for actions or inactions of debtors, lawyers, or government bodies.
You agree to indemnify PaisaRecover against any claims, damages, or expenses arising from: your use of the Platform, your breach of these Terms, your violation of any applicable law, or fraudulent or inaccurate information provided by you.
Any dispute arising out of these Terms shall first be attempted to be resolved through amicable negotiation. If unresolved within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be as determined by mutual agreement. The language of arbitration shall be English. The courts in India shall have exclusive jurisdiction.
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms. You may delete your account at any time by contacting us. Termination does not affect any rights or obligations that accrued prior to termination.
These Terms are governed by and construed in accordance with the laws of India.
We may modify these Terms at any time. Changes will be posted on this page. Continued use of the Platform after changes constitutes acceptance.
